Private Membership Association (PMA) Agreement 

Health and Breath Coaching Services

1. Introduction

Welcome to SolElevation PMA (the "Association"). This Agreement sets forth the terms and conditions under which individuals and groups (referred to as "Members") may receive health and breath coaching services (the "Services") provided by the Association. The Association operates as a Private Membership Association and provides services exclusively to Members.

By becoming a Member of this Association, you agree to be bound by the terms outlined below.

2. Membership Requirements

Eligibility: To access the Services, individuals and groups must become Members of the Association by completing the Membership Application and agreeing to the terms and conditions of this Agreement.

Voluntary Membership: Membership in the Association is voluntary, and Members are not required to participate in any of the services offered. All Members must affirm their understanding and agreement to the terms of this Agreement upon joining.

Membership Agreement: As a Member, you acknowledge that you are entering into a private contractual relationship with the Association based on the principles of freedom of association and mutual agreement.

3. Services Provided

Health and Breath Coaching: The Association offers health and breath coaching services, including but not limited to:

   - One-on-one health coaching sessions.

   - Group breathwork sessions.

   - Workshops, classes, and resources related to health and breath practices.

Private and Confidential: All coaching services are provided in a private, confidential, and respectful manner. Members may discuss personal health matters, and the Association respects privacy in all interactions.

4. Membership Benefits

Access to Services: As a Member, you are entitled to access the health and breath coaching services provided by the Association in accordance with the agreed-upon terms and availability.

Member-Only Events: The Association may offer exclusive events, workshops, and webinars for Members on topics related to health and breath coaching.

Private and Customizable Experience: Members can tailor their experience by selecting specific services, scheduling sessions, and engaging in one-on-one or group coaching opportunities.

5. Membership Fees and Contributions

Contribution for Services: Membership in the Association may require a contribution (donation, subscription, or fee) for access to certain services. The contribution may be subject to change and will be outlined in the Member's specific membership package.

Voluntary Contributions: Contributions to the Association are voluntary and may be considered donations or fees for the services rendered. Contributions do not create any ownership interest in the Association.

No Refunds: Contributions or fees are non-refundable, as they are considered voluntary and based on the mutual agreement of the Member and the Association.

6. Member Conduct and Responsibilities

Respectful Participation: Members agree to participate in all activities in a respectful manner and abide by the Association’s private guidelines, which include respect for confidentiality, adherence to the guidelines for breath and health practices, and other ethical standards.

Personal Responsibility: Members are responsible for their own health and well-being. The Association provides coaching, guidance, and education but does not assume liability for any outcomes resulting from participation in the Services.

7. Limitations of Liability

Private Nature of Services: By entering into this Agreement, you acknowledge that the Association operates as a Private Membership Association and is not a commercial business. The Services provided are for educational and personal development purposes only and are not intended to diagnose, treat, or provide medical advice.

No Medical Advice: The health and breath coaching services are not a substitute for medical care. Members are encouraged to seek professional medical advice if they have any medical concerns or conditions.

Release of Liability: The Member agrees to release and hold harmless the Association, its officers, coaches, and affiliates from any liability related to the health or wellness outcomes associated with participation in the Services.

8. Termination of Membership

Voluntary Withdrawal: Membership may be terminated by the Member at any time by notifying the Association in writing. The Member will cease to have access to the Services once their membership is terminated.

Termination by the Association: The Association reserves the right to terminate membership if a Member fails to adhere to the principles of the private agreement or engages in conduct that disrupts the services or community.

9. Confidentiality and Privacy

Confidentiality of Information: The Association respects the confidentiality of Member information. Any personal data or health-related information shared with the Association during coaching sessions will be kept confidential and not shared with any third parties unless required by law or with explicit consent.

Private Nature of the Association: As a Private Membership Association, the activities and communications within the Association are considered private, services are offered to men and women in their private capacity. Members agree to respect the privacy of other Members.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Ireland recognizing the private and voluntary nature of the Association.

11. Amendments

The Association reserves the right to amend or update these Terms and Conditions at any time. Members will be notified of any changes, and continued participation in the Services constitutes acceptance of the updated terms.

12. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through private and amicable means, including mediation or arbitration, in accordance with the policies of the Association.

By becoming a Member of SolElevation PMA, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
